DJ INVITATIONAL CONTEST

 

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT IMPROVE CHANCES OF WINNING. VOID WHERE RESTRICTED OR PROHIBITED BY LAW.

 

This Contest is not sponsored, endorsed, administered by or associated with Facebook.

 

  1. Overview: The R3HAB DJ Invitational Contest (“Contest”) is a contest of skill that asks entrants to create a mix at least twenty (20) minutes in length (the “Mix”).

 

  1. Eligibility: Open and offered only to legal residents of the 50 United States and District of Columbia, 18 years of age or older at the time of entry, unless otherwise noted below. Void where prohibited. Employees, officers, brokers, agents and directors of Glow Washington DC (“Sponsor”) and each of Sponsor’s subsidiaries and affiliated companies, advertising, promotion or production agencies, prize providers and their immediate family members or individuals residing in their same household, are not eligible to participate or enter. Void in Puerto Rico, U.S. territories and possessions and wherever prohibited or restricted by law.

 

  1. Entry Period: Contest begins at 12:00:01 pm Eastern Time (“ET”) on 6/5/2015 and ends at 11:59:59 pm ET on 6/18/2015 (the “Contest Period”).

 

  1. How to Enter: Entrants must have a Facebook and Wavo account in order to enter. Accounts are free. To create a Facebook account, visit www.facebook.com. To create a Wavo account, visit wavo.me. To enter the Contest, visit the Contest website located at https://wavo.me/panoramaproductions/r3hab-dj-invitational (“Website”) during the Contest Period. Then, follow the instructions for uploading your Mix on Wavo. For the purposes of this Contest, a “Submission” shall consist of entrant’s uploaded Mix and all other required entry form information. Only Mixes that meet the Mix Requirements/Restrictions set forth below will be considered valid Submissions. Entrants may enter more than once, but each entry must contain a unique Mix. If a duplicate Mix is received by more than one entrant, the first entry will be valid and all duplicate Submissions will be void. Entrants agree to be bound by all decisions of Sponsor, which are binding and final. All Submissions must be entered and submitted during the Contest Period.

 

  1. Mix Requirements/Restrictions:

 

In order to be eligible, a “Mix” must meet the following criteria:

 

  1. Be original and owned and created by entrant; or properly licensed by entrant (i.e. each sample that is subject to copyright protection or license from a third party is properly credited, and the right to use that sample has been obtained);
  • .

 

Mixes may not:

 

  1. Contain material that violates or infringes another’s rights, including but not limited to, privacy, publicity or intellectual property rights, or that constitutes copyright infringement;
  2. Disparage Sponsor or any other person or party affiliated with the Contest or contain material that promotes bigotry, racism, or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation, age, or any other legally prohibited basis;
  3. Contain any material that is libelous, defamatory, obscene, vulgar, threatening, abusive, pornographic, hateful, or is otherwise objectionable;
  4. Contain material that is unlawful, in violation of, or contrary to the laws or regulations in any state where the Mix is created;
  5. Include any personal or private information about entrant or anyone else;
  6. Be intended for advertising, marketing, or any commercial use; or
  7. Have won a contest or been previously published, such as, but not limited to, on blogs, on music websites, or in connection with other Mix contests, unless the Mix’s changes are considered significant by the judging panel.

 

Sponsor reserves the right to remove any Mix that it determines in its sole discretion to have violated the Mix Requirements/Restrictions or if an entrant otherwise violates or attempts to violate any portion of the Official Rules.

 

  1. Winner Determination: The winner will be determined via the following two-phase process:

 

  1. Voting Phase: During the Contest Period entrants should request their friends and family to vote for their favorite Submission. The five (5) eligible Submissions that have the highest number of votes at the end of the Contest Period will be reviewed by the judging panel as potential “Finalists.” In its sole discretion, Sponsor reserves the right to select an alternate Finalist should the voting for any Finalist appear to have been tampered with or manipulated in any way. Multiple entrants are not permitted to share the same email address. Entrants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering inducements to members of the public, as determined by Sponsor in its sole discretion. Use of any automated program to vote will result in disqualification. In the event that the judging panel, in its sole discretion, believes that it needs to draw from a larger number of entrants, the judging panel reserves the right, in its sole discretion, to review additional Submissions during the Judging Phase. Except as otherwise set forth in these Official Rules, only the top five (5) eligible entrants as described above are guaranteed to be judged in the Judging Phase.

 

  1. Judging Phase: During the Judging Phase, a qualified panel of judge(s), as determined by Sponsor in its sole discretion, will select the potential prize winners from the Finalists based on the following criteria (“Judging Criteria”):

 

  1. Appropriate opening for R3HAB (25%)

 

The Finalist with the highest overall score will be deemed the potential prize winner of the Contest. Sponsor reserves the right to not select a winner, if, in its sole discretion, it does not receive a sufficient number of eligible and qualified Submissions.

 

  1. Public Voting. Voting is open to all legal residents of the 50 United States and D.C. To vote, visit the Website. Individuals may vote once per day per Submission. Sponsor is not responsible for voting complications or unregistered or unrecorded votes.

 

  1. Notification of Winner. The potential winner will be notified on or around 6/18/15 via Wavo and/or the email address provided upon entry into the Contest. In the event that a potential winner does not respond to any such notification within forty-eight (48) hours of the date of notification, a disqualification may result, and the prize may be forfeited. In such event, the entrant with the next highest score, as determined by the Judging Criteria, may be named as the alternate potential winner for the Concert Market, time permitting. If a potential winner fails to comply with any of the obligations, requirements, terms or conditions of these Official Rules or is found to be ineligible or unqualified for any other reason, the potential winner may be disqualified. Potential winners may be required to complete and return to Sponsor an Affidavit of Eligibility/Release of Liability and, if legally permissible, Publicity Release (collectively, “Releases”) within three (3) days of the date notice or attempted notice is sent. In addition, potential winners may be required to certify, on information or belief, that their Mix is their original creation and has not been published or publicized and has not won another contest. If a potential winner fails to complete and return any required Releases within the specified time period, that potential winner may be disqualified and an alternate winner may be selected. Winners may be required to produce government-issued identification.

 

  1. Prize: One (1) winner will have the opportunity to open for R3HAB on June 20, 2015 at Echostage, located at 2135 Queens Chapel Road NE, Washington, DC 20018. There is no retail value of the prize.

 

The winner must be able to use CDJ’s. No controllers are permitted. The time that the winner opens will be determined by Sponsor in Sponsor’s sole discretion.

 

Concert appearance is subject to additional rules and regulations set forth by Echostage. Sponsor is not responsible if concert is delayed, postponed or cancelled for any reason. All expenses not expressly set forth in the prize package will be winner’s responsibility. Sponsor is not responsible for any travel, lodging or other expenses associated with attending the concert or using the prize. No substitution, cash redemption or transfer of prize by winner is permitted. Prize consists of only those items specifically listed as part of the prize. Prize is non-transferable. Winner must comply with all laws and regulations, as applicable. Winner shall conduct themselves at all times in a socially responsible, respectful and appropriate manner; and, should they fail to do so, the prize may be immediately terminated and the Sponsor may pursue other legal sanctions against the winner.

 

  1. Release: By participating in this Contest, entrants agree to be bound by the Official Rules and the decisions of the judges. By participating in this Contest, entrants hereby waive and release, and agree to hold harmless the Sponsor, Facebook, Fadil El Ghoul, wavo.me INC, Echostage, and their respective parents, subsidiaries, affiliates, distributors, licensors, advertising and promotion agencies and all of their respective officers, directors, employees and representatives and agents (the “Released Parties”), from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and/or property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of any prize, or their participation in this Contest, or any Contest or prize-related activity. Winner assumes all liability for any injury or damage caused, or claimed to be caused, by participation in this Contest or use or redemption of any prize.

 

  1. Ownership and Publicity: As between entrant and Sponsor, entrant owns the Submission provided in connection with the Contest. Entrant represents and warrants he or she has the full right, title and interest or a right and license from the owner to provide the Submission and comply with all these Official Rules. By entering this Contest and providing a Submission, entrant grants Sponsor and its parent companies, affiliates, subsidiaries, agents and licensees, a royalty-free, unconditional, irrevocable, and perpetual right, license and consent, without any compensation, consideration or further notification, to use, edit, reproduce, print, publish, display, transmit, distribute, sell, perform, adapt, enhance, or create derivative works from the Submission, and to use and refer to the entrant, his or her name, likeness, image, distinctive characteristics, city, state, any statements made and prize information, for any purpose, including but not limited to editorial, advertising, trade, commercial, and publicity purposes in any media throughout the world. Sponsor also has the right to arrange for the news media and journalists to attend and, if applicable record, any public appearances and statements of the prize winner. Sponsor shall not incur any liability whatsoever to the extent Sponsor chooses to refrain from any exploitation of its rights hereunder.

 

  1. Limitation of Liability: Sponsor and their respective agencies are not responsible for lost, late, damaged, delayed, incomplete, illegible, or misdirected entries, entries not received by the entry deadline, or for electronic, network or computer failures or malfunctions, lost or unavailable network connections, or failed, incomplete, garbled or delayed computer transmission that may limit a user’s ability to participate in this Contest, or other hardware, software or technical errors of any kind including any injury or damage to any person’s computer related to or resulting from participating in the Contest. Sponsor assumes no responsibility for undeliverable e-mails resulting from any form of active or passive e-mail filtering by a user’s Internet service provider and/or insufficient space in user’s e-mail account to receive e-mail. Sponsor reserves the right to cancel or modify the Contest (or any portion thereof) if fraud, misconduct or technical failures destroy the integrity of the Contest or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest, as determined by Sponsor, in their sole discretion. If the Contest is so cancelled, judging will be conducted from among all eligible entries received prior to the time of termination. In the event a dispute arises regarding a specific individual entitled to receive the prize, entry will be declared made by the “authorized e-mail account holder” and any damage made to the website will also be the responsibility of the authorized e-mail account holder of the e-mail address submitted at the time of entry. “Authorized e-mail account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entrant may be requested to provide Sponsor with proof that the entrant is the authorized e-mail account holder of the e-mail address associated with the Submission. Proof of submitting an entry will not be deemed to be proof of receipt by Sponsor. Any use of robotic, automatic, programmed or the like methods of participation will void all entries by such methods. Sponsor reserves the right to prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation as stated herein or with any provision in these Official Rules.

 

  1. Disputes: Each entrant agrees that (a) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any Prizes awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in the State of California, (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys’ fees and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and the Sponsor in connection with this Contest shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of California.

 

By entering the Contest, entrants acknowledge that they are familiar with the provisions of California Civil Code Section 1452, which provides as follows:

 

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS FAVOR AT THE TIME OF EXECUTING THE RELEASE WHICH IF KNOWN BY HIM MUST BE MATERIALLY AFFECTED HIS SETTLEMENT WITH THE DEBTOR.

 

Accordingly, by entering the Contest, entrants (on their behalf and on behalf of their heirs, executors, administrators, personal representatives, predecessors, successors and assigns of any of the foregoing, and all other persons and entities asserting rights of or acting on behalf of the entrant) hereby waive and relinquish any right or benefit which entrant or such persons has, have or may have against Sponsor and their respective agencies under Section 1542 of the Civil Code of the State of California, or under any similar statutory or common law of any other jurisdiction to the full extent that any such person may lawfully waive such rights and benefits pertaining to the releases set forth in these Official Rules and Sponsor’s Privacy Policy.

 

  1. General Terms. INTERNET CAUTION: ANY ATTEMPT BY AN INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF THESE OFFICIAL RULES, AND MAY SUBJECT ANY PERSONS INVOLVED TO CRIMINAL AND CIVIL PROSECUTION, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW. The Contest is subject to all applicable federal, state and local laws and regulations.

 

  1. By participating in this Contest, entrants acknowledge and agree that Sponsor may collect and use the personal information submitted by entrant to administer this Contest and pursuant to Sponsor’s Privacy Notice, located at http://www.clubglow.com/privacy.html.

 

  1. Winner’s List: Sponsor will post the name of the winner on the Website after the winner has been selected.
